Small house registered as a garage

Hi Everyone,

I would appreciate any advice anyone can give on the purchase of a property on the South Costa Blanca. The property consists of a main house, and at the bottom of the garden there is a small house with a couple of bedrooms, shower etc. Our solicitor tells us the the small house is registered as a garage, that the seller is starting the process to legalise it as a dwelling, but that we should go ahead and sign the deeds, money transfer etc. I’m very concerned about this and think it should be legalised as a dwelling before the deeds are signed and the money transferred.
Has anyone else experienced ths sort of thing and are in a position to advise the next steps?

Dear Kris

I disgree with the advice given by you lawyer. However,  we would obviously need to make searches with the town hall to find out if the legalization is feasible.

What we have done in similar situations is to: a) check with the town hall that the legalization is posible, and b) in case the vendor insists in completing the purchase before the property is legalised, to make a substantial retention on the purchase price until the moment the legalization has been completed successfully.

In any event, this is obviously subject to negotiations with the other party.
