How do you pay the fee before applying for residence card?

Hi -


Pretty basic question, but I can’t find the answer anywhere.


I’m a non-EU citizen, married to a Spanish citizen.  After a few years of marriage, we’re moving now to Spain 😊, so I’m applying for a residence card.


I have our libro de familia, certificado literal de matrimonio, and the form Ex-16.  And I finally got an appointment with the oficina de extranjeria.


Now I’ve noticed something unusual on form Ex-16.  If I don’t have a NIE, I must submit a “documento acreditativo del abono de la tasa por expedicion del certificado” (document verifying payment of the fee for the issuance of the certificate).

Salvo en los casos de no tener asignado NIE con car?cter previo a la solicitud, documento acreditativo del abono de la tasa
por expedici?n del certificado (en el resto de los casos, el ?rgano administrativo ante el que se presente la solicitud, previa

We don’t really understand what this is or what to do.


I don’t have a NIE. I’d been told I get the NIE as part of the residence card (tarjeta de residencia). Is that correct?


Assuming it’s correct that I get the NIE as part of the residence card, then how do I pay this fee? I’ve read different things on different forums:


- Some people say I need to complete “Modelo 790 codigo 012”, a carbon form which I can only get from the police office, take it to a bank, pay a fee, then submit the bank’s stamp with my application for tarjeta de residencia.

- Other people say I need to complete “Ex-14”, take it to the bank, pay, then submit that form with my application for tarjeta de residencia.


I’ve called government offices, but can’t get an answer.


We’d appreciate any ideas you might have. I’d love to do this step correctly before my appointment so I don’t get turned away and have to wait another 3 months until I can get another appointment with the extranjeria office!

Not sure if same for non eu but for eu:
You need the 790 form which you get from the police office, fill it in, pay the fee at the bank, take receipt and other docs with you to appointment. the ex14 is for nie only. the ex-16 will get you residencia AND nie together.

The downloadable form is for getting certificates for criminal record checks, wills and life cover/death certificates, I think, not for residencia. The 790 version for residencia etc is code 012. the online one is code 006. Not aware of the code 012 being available online…maybe someone else knows better?

Thanks for the advice.

I think what you’re talking about is for EU citizens who need to get a NIE.

Do you know if the procedure is the same for non-EU citizens applying for the residence card?  I’m applying for the tarjeta de residencia as the spouse of a Spanish citizen, and I’m not sure if I need to apply for and pay the NIE fee before applying for that card.

I’ve spoken to a few lawyers.  Some say that I get the NIE along with the tarjeta de residencia.  Some say I need the NIE before getting the tarjeta de residencia.  And some say that I apply for the NIE after the first step of applying for the tarjeta de residencia.

And for what it’s worth, I can’t find a government office anywhere that answers the phone and can answer my question.  Sigh…

I would just apply for a NIE now, except some lawyers told me that it actually would make my application for the tarjeta de residencia take much longer.

Hello,

I am US citizen, anesthesiologist cardiothoracic, and married to a Spaniard.  We married in Zamora.  I am applying too for my residence card, but since I’m travelling back and forth between nuestro piso en zamora y de EEUU donde hay mejor trabajo (por ahora) no se si realmente seria buena idea conseguirla porque luego si me nacionalizo tengo que explicar porque paso tanto tiempo en EEUU.

But here is how easy it was to get:

Acto de matrimonio
Solicitud
DNI de esposa
Passaporte
Certificado de convivencia

I was able to do it in one morning- get the acto de matrimonio paper then empadronarme en zamora y el dia siguiente me dio el certificado de convivencia.

After speaking to a spanish immigration lawyer today (just now over skype!).  I will go ahead and do it even if i have to leave a little bit out of spain.
