Hi, I am currently an Aupair in Madrid and am wanting to fly home to the U.S for Christmas.  I arrived in Spain this past May so obviously I am past my 90 legal days in this wonderful country. I am just wondering if I will be allowed back into the country after I travel home for 2 weeks. Any advice?

Accordingly any information we hold about you and your travel arrangements may be disclosed to the government authorities of any country in your itinerary. 
What if I refuse you permission to release my data to the authorities? If you do not provide us with the required passenger information in you will not be accepted for travel at Check-In and no refund will be provided on the seats held for you.

What passenger information is required?

Spain (inc. Canaries and Balearic Islands):

Laws in force in Spain require all airlines to collect in advance the following information from all passengers travelling to Spain (including the Canaries and Belerics Island from the UK, IRELAND, MOROCCO SWITZERLAND AND USA

Passport information, including:

  * Full Name (as they appear on the passport)
  * Date of birth
  * Nationality
  * Passport or Travel document number
  * Type of Document
  * Issuing State

My question is very similar and I didn’t really understand the response that was posted! I am trying to go as an aupair to Spain, and they need me ASAP. I am not sure whether I should just go ahead and go illegally, (on a tourist visa), or wait it out and try to get paperwork done legally.

I would obviously prefer to go the legal route, but if this opportunity begins to pass me by, then I want to go ILlegally…

And the other thing is, I am 28, and to work as an au pair in Spain you have to be between 18 and 27! So not even sure if there IS a legal way..

And last question is, will I have trouble travelign around the EU (past 90 days) or will the only problem be if I came back to the US and was trying to get BACK into Spain???!!!

Lots of questions!!! HELP!!!!

What I meant was I don’t think she’ll have problems getting back into Spain.

If you overstay your visa, then yes, Spanish officials shouldn’t let you back into the country, but in all honesty, I’m sure young female American au pairs who overstay their tourist visas are not very high on their priority list. Just speak English and act like a tourist; I’m sure they’ll just wave you by. 

Once you’re already in the Schengen area (most countries in Europe) you shouldn’t have any problems traveling within the area. Have you seen “The Schengen Visa: Staying in Spain and the Schengen Area” (http://www.spainexpat.com/spain/information/schengen_visa_spain/)?

I don’t think you will have a problem.  I Have been in Spain since May and have already over stayed my legal 90 days. I was just on vacation to Belgium, Netherlands,  and Germany. I had no problems. Once you are actually in the EU you can travel between countries without them even looking at your passport. The only thing I would recommend would be to purchase a cheap ryanair flight so they don’t question you when you go thru customs when you make your first trip to spain just to be on the safe side. I paid 20$ for a cheap flight to Paris just to have something to show I wasnt staying in spain HA. Really the customs is a joke. (I got hit on by the passport control guy… a problem being blond in Spain) Anyway you will find over here that Spain is a lot of talk and not much reinforcement on most of their rules etc.

You are making me feel a lot better about this! I read online somewhere that Americans are known for doing everything “by the books”—which I know is so true!!!

Flying into Spain is fine I just had a cheap flight for a week later to Paris. Sneaky I know but it makes it look like you are just a tourist traveling around europe etc.  I actually didn’t have any problems and did not have to show this other ticket, but another aupair who i told to do the same thing was asked for her next flight info when she was leaving the U.S. This is because we both had 1 way flights. The airlines are supposed to ask you for this information, but if you catch them on a busy day etc they don’t bother. Just to be on the safe side I would suggest doing it.

AHA! I gotcha…that makes perfect sense…yeah, I will definietely do that. Also, was just looking at my passport…I backapcked all over years ago, and I have no stamps except for where I entered the EU and exited! So this is all making better sense now!

I am in Madrid and love Madrid.  I am an Aupair for 2 kids (4 and 7). It def. has its frustrations but overall I am very happy. Being in a big city makes a huge difference since I am in Madrid and close to everything. I don’t think I would enjoy my time if I wasn’t in a big city with lots of interesting people and things to see. (I went on vacation with the family in August and hated my life… Small beach city, nothing to do but hang out with the family = NO BUENO) : )

Im an Australian Aupair and my 90 days is about up end of this month… I do not want to go back to australia any time soon and my boyfriend is EU citizen and supports me aswell. Should we let immigration know? I dont want to be ilegal but its so hard im being forced too… and we plan to marry eventually but i dont want to marry just for the passport if that makes sense. Has any one here overstayed the 90days and been ok? So if we do get married in lets say a year will this be a problem down the track if i apply for an EU passport through him without having documents and they see i was illegal?
