Debt and Divorce.  Need help urgentlyQQQQ

I live with my husband in spain for the past three years.

He was doing some work for this guy (cash in hand), the work was estimated for 60K, he took a 25K deposit, but when the guy came over, my husband had done very little and the money had gone on other jobs.

To cut a long story short, this guy is coming after me (being the wife) and try to force me to sign accepting this debt so he can put a charge on my home.

My husband has told them that the deposit went into my bank account and I own the home out right   Both of them are bulling me into signing.  My husband has already stated that he does not intend to pay one cent of it, but rather that I paid it out of my proceeds from the sale of the house.  He also has a pension, which he says I am not allowed to touch.

He has in the past got me to sign for loans etc, as he was self emloyed and could not get credit, he promised fiathfully he would pay the payments, but he then refused to pay and although he took all the money, insists its my debt and nothing to do with him. 
My husband can be a very violent man, he keeps me short of cash, and even takes the little money I get paid from a days cleaning a week off me.

I have no money so can not afford to pay to apply for a divorce/  He has threatened that he will stop paying the mortgage and the house will be repocessed, he doesnt care as he didnt pay one cent towards the deposit, I put it all up,  He will walk away with his pension intact, leaving me and my young son pennyless, on the streets and owing his debt… The debt had nothing do with me and I did not benefit from it at all.

Where do I stand, How can I get help, what can I do?...

Hi Carly

1st and most importantly If you ever feel threatened or been Abused by your husband Call 062 This is the Guardia Civil and they will Help You.

2nd NEVER EVER Sign Anything If they try anything again call 062.

For the separation of things this falls down to legal proceedings I would suggest getting in touch with a lawyer asap.

Can I expand this question a bit and ask if anyone knows about the legal aid system in Spain, if indeed there is one?  Both for Carly’s benefit and for others out there.

This is a good question…...... If Carly is resident and has Empadronamiento Cert for were she lives there is a good chance yes…

But…...

This only works to secure a conviction for a criminal offence…. for any other legal issues divorce or personal issues she has to pay out of her own pockets.

Since the other half is violent she has a good chance to get help either from British Consul or Spain legal system
