... what do I do in order to be able to claim my late mother’s Spanish assets?

We are talking two properties, plus bank accounts and life insurance policy. Since her death nearly two years ago, things have dragged on painfully, and I am now at the point where I actually have money (from her recently released UK assests) to travel to Spain if needed (I reside in the UK).

What can I do beforehand though? Her partner, who still lives in one of the properties, has tried as best he can to get things rolling but all I’ve been told of are apparently false promises by the insurance company involve (Santa Lucia) where they say “We’ll pay up soon”, then keep asking for more paperwork or details.. now to the extent they want stuff that I simply can’t get hold of due to data privacy laws etc.

I’ve waited nearly 2 years just to get two small UK assests sorted, any advice on how to avoid a similarly painful period for the Spanish assets would be hugely appreciated.

Hi Nick,

I am assuming that you have obtained UK probate and you are the sole heir, or are representing the heirs.

1st step…...apostille and translation of probate.

2nd step…..obtain a “certificado de ultimas voluntades” and a “certificado de contratos de seguros de cobertura de fallecimiento” .....for this you will need an original death certificate (if it’s a UK death cert you will need to get it apostilled and then translated.)

All this can be done without you having to come to Spain.
