Baby born in Spain to non EU parents

Hi,
I have recently given birth to a baby in Spain, however both myself and my husband are non-EU citizens and do not have residency in Spain, but want to know where does the baby stand legally? We have applied for an Australian passport for her as I am an Australian, however are not sure what her rights are in Spain….can she get a Spanish passport? I have had mixed feedback from people. Some say yes, just apply, others say yes but only after one year living here, and yet others tell me no, the most she can get is a ID card at age 16 if we are still here ( which we probably won’t be, but who knows).
We are not illegal or over-stayers as we work on a ship that cruises the med, and is based in Spain in the winter. Legally we can be here under the ships flag, but it is certainly tricky to explain this to some officials that aren’t used to dealing with ships crew.
We are considering staying here and starting our own business, however that is a whole new issue once we leave the protection of the ship.
Can anyone can help clarify the rights (if any) of my baby?
