travelling to france (driving) but have not applyed for residencia

I’m an EU citizen and my husband is american. we arrived in EU beginning of april (throught germany) stayed in france for a while and definitly moved here at the end of may.
we have not yet applied for residencia ( we will in the next few weeks)
we are travelling to france next week-end (driving). could we have problem crossing the border if we get stopped ( the stamp on my husband passport will be passed the 90 days of a few days?). is that a problem ? should we be concerned . notice that we are renting a car going to france

Also do we need to make an appointment at the foreign police to apply for residencia or we just show up very early morning?
we are leaving 40 min away from barcelona can we just go to the local police station to do this ?

I’m a bit paranoid about immigration and they law after dealing with US immigration couple of years ago 😊

Effectively there are no borders between France and Spain you just drive in and out ? and surely if you are an EU citizen and you are married your husband has rights ?

Some offices operate an appointments system others do not - perhaps someone locally can post.
