Can anybody enlighten us on the following problem.
My Son and family decided to buy an apartment in Spain and found one off plan this was in December 2005. A deposit of ?16000 was paid to Atlas International, with a contracted completion date of 30th September 2007.
The apartment was actually completed in May 2008. In the meantime obviously the exchange rate was not as good also they have had a baby, which means if they completed they would put themselves in hard financial difficulties ( due to the expense of baby and the additional ?10500 due to the exchange rate.
So they decided to pull out, but the builder is refusing to return any of the deposit that they paid, Atlas International are being so un helpful to them also, I would of at least thought they could have negotiated a 50:50 responsibility. Is there any merit in taking this through the legal system knowing what Spanish law is like.
