2 ? years ago, the 29/09/2006, I did sell my car to a Spaniard from Huesca. The RACC (Automobile Club of Catalu?a) were in charge to make the papers and the sale contract. Everything went without any problems, we did sign the sale contract, the buyer paid the car (cash), and went back to Huesca with the car.  One week ago I did receive an order to pay some traffic fines from the province of Huesca (where I never have been during my whole life) and it did turn out that the buyer of the car never did change the car to his name!  I did call the RACC and am waiting for some response. Of course I do not want him to continue to drive a car, which for ?Trafico? does officially belong to me. I plan to go to Trafico and also inform the police about this. Any advice or opinion on what to do will be highly appreciated.
Thanks, Eva33

I had no reply to my post, so I do like to inform you what is happening.
I went to the RACC in Tarragona in order to talk with the people which do pretend they can not do the register change of the car, because the buyer does not collabarate and does not pay his dues. They told me to go to the police and make a “denuncia”. The “Mossos d’Esquadra” where, to my big surprise, very kind and polite, but did not accept the “denuncia” because this is not a penal criminal case. They did send me to trafico to put the car “de bajo”. Trafico, which is as far as I know a national thing, did refuse to cancel the circulation permit, because I do not live in Tarragona anymore! So the fact is: In Spain you can sell a car, and if the buyer want, he will be able to drive the vehicle without changing the owners name at Trafico for years (In my case 2/12 years). The seller will be reponsable for all damages caused by the car and pay alt the trafic fines as well as taxes etc. What a big mess! I did contact a German lawer in Alicante. He was very kind but told me he could not do anything about this…

You should have known this before buying the car.  The information is even on this site ...
That’s one of the reasons why you should never buy a car in Spain without going to a car dealer or seller.
Spanish laws are often a little wierd for us European people.  😉

Before writing some “smartt/sarcastic” remarks, try to learn to read the posts carefully. I DID SELL A CAR TO A SPANIARD (not buy)! There is absolutely nothing I could have known about it in this case
. I did everything in the correct and legal way, and an official spanish automobile club (RACC) was supposed to do the paperwork.
