I live in a newish community (16 months). I live on the ground floor. Adjacent to our terrace is another small concrete area not designed as a terrace because it is too high off the ground to reach safely from the communal gardens, it is devided from our terrace by a low wall and only 15 meters from the pool and communal terraces anyway.
It would benifit us to put a small gate and step into the deviding wall, thus allowing easy access to the pool area for our kids.
The majority of our community have agreed in principal to us adopting the area, but are unsure as to wether their is a legal precident preventing us from sorting this out as a community or if there is a horizontal law preventing us even discussing it further.
We are not looking to own the terrace and would also be prepard to pay a fair rent into the community fund for its use.
Can anyone offer advice?.
