hi there, im a non-EU who wants to marry his Spanish girlfriend…and the amount of paperwork and jumping through hoops to do it is a bit too much…from what little i’ve gathered so far, the gibraltar option doesn’t sound bad, but a couple questions, see what you guys think:

—if (hypothetically speaking) i were here on an expired tourist visa (very expired), would i have any troubles getting across the border from Spain to Gibraltar?

—is the process as simple as i’ve been led to believe?  all the information i’ve found is, you show up with your birth certificate, passport, and a sworn affidavit or something like that to prove youre not married and in as little as 24 hours your in there.

—is it super hard to get the libro de familia with a gibraltar marriage?

any help you may provide will be greatly appreciated, thanks!

This SITUATION again I WILL REPEAT….

IF you?re Visa Has Expired or “VERY VERY EXPIRED” then your classed as an Illegal immigrant in Spain or anywhere else for that matter…

If your seen to cross borders with an expired Visa chances are you be detained fined prosecuted and sent back to were you came from…

Also A big WARNING Sticker Stuck to your passport…

My advice is Re apply for a VALID visa or Leave….

IF you are legally able to reside/work in Spain - what is the problem?
Only saying this as if you do not have the right to be in Spain any longer - then they will surely turn you away at the border (or worse) trying to get into Gib. 
IF you are legal here - then yes, the system in Gib for marriages (I believe) is quite simple/straightforward.
BUT they WILL detain you at the border if you are checked thoroughly if they think there is anything amiss. And even if you did get in - you have to get out again! (I am sure marriage will not change your residency status). 

Why do you want to marry your GF (sorry - not being personal here) - is it so you can be legal? 

I knew a German/Ukranian couple - where she had overstayed her visitors visa - and they were thinking of a marriage in Gib - but realized it was too risky as she would likely be found out and thrown out!

Sorry - just being practical here.
Good luck if you are marrying for commitment/love etc… But you do need to be legal!

All we can say… The Laws have changed lots of red tape and punishments extreme.

Detained, Passport Stamped and Documented. your details on EU system for illegal doings example over expired visa etc.
