Need to get my freelance worker visa but have overstayed tourist visa already

Hey everyone,

So my question is whether people have any experience dealing with trying to get a freelance or contract work visa when they’ve already overstayed their tourist visa. I’m over by about 40 days.

There’s a company here in Spain that wants to hire me. They’re willing to do full time contract but since I rather freelance for a couple different companies I think I rather go the freelance route. Question is, once I get my health letter and police record paperwork - will the fact I’ve been here over the 90 days cause a problem? If so I may just try to get a new US passport from the Embassy.

to apply for residence with work permit either employed or self employed, you need a residence/work visa.
if you are an overstaying tourist,
you can apply for arraigo laboral after a continuous stay of 3 years.

Well yeah, i understand I’ll need a work visa. I called several offices today and was told that for freelance visas I need to start the paperwork from my home country (USA) and that for regular contract work visas I can start it from here in Spain. Since I really rather not go back to the US right now I will probably pursue the latter.
