Hi,

I’m Danish and would like to settle in Spain with my Japanese girlfriend. I’m currently living in the UK, she’s here on a tourist visa. I’ve figured that the only way of doing this is getting married. I’ve come up with a scenario and was wondering if there would be an easier way around it or would it be at all possible.

1) As follows.. Going to Spain together. My girlfriend on a Schengen visa and applying to get married soon after arrival as i know this can take some time.
A) Would this be possible?
B) What papers would we need and where would we have to go?
C) Would I have to settle in Spain first and then tell her to come? If so for how long? What status must i obtain?
D) Anything else I should get done?

2) Would she be allowed to work legally and get healthcare following this, in Spain, Schengen and the UK?

3) Obviously getting married in the UK, Denmark or Japan and then move to Spain would maybe be easier but I was hoping to go ASAP and maybe miss a hurdle as doing it this way would mean for either of us going to Japan first (Her to get proper entry clearance or me to get married). If doing it this way what would be needed to settle together in Spain?

4) Another thing that might help the case though I’d rather not do it would be to become a Spanish National. I could do this as I was born in Spain and my dad is Spanish but I would lose my Danish Nationality. Would it be of any help though?

Help from anyone with a similar experience or any knowledge at all on the subject would be greatly appreciated.

Thanks P

valevale,
summarizing the situation
your japanese girlfriend needs an eu residency.
the main problem is she is in the uk on a tourist visa.
you want to marry each other.
since you are danish, you are her first link to an eu residency.
when you get her a residence card in denmark, she can enter spain with it and apply for a residence card as a relative of an eu citizen, while you register yourself as a resident.
i will give you the link when you get to this point.
you can go to the danish consulate in london and ask how you can get her a residency in denmark thru marriage.
ask if it is possible to marry her at the danish consulate.
then just meet their requirements.
