Does anyone know the process of obtaining residency by being married to a spouse who has a Spanish passport?
We’ve been married for 4 years and live in the US. My wife just obtained her passport/residency through her father.

the spanish consulate that issued her passport, is the one that will issue you your eu citizen family member visa. they will inform you what you need to submit. what is your citizenship?

Thank you so much for both of your responses!
My citizenship is through the States. ( i was born in the former Soviet Union, now it’s called Uzbekistan, but have been living in the states since i was 2 years old.)
Would you happen to know how long that would take?

maybe 6 months to a year.
but if your wife submitted her marriage certificate to the spanish consulate when she applied for spanish citizenship, it may take even less time. the marriage would have been annotated in her spanish birth certificate.

Oh Ok.
But she doesnt have a spanish birth certificate bec. she was born in Mexico City. She became eligible when her father received his citizenship.
Ill check with her again.

once somebody is informed that he has been given spanish nationality, he submits his birth certificate (in your wife’s case, mexican birth certificate) to the spanish consulate or the registro civil central in madrid and he is issued a spanish birth certificate. in other words, she is registered again.
in order to get issued a spanish passport and dni for the first time, you must show your spanish birth certificate to the spanish consulate or the comisar?a in spain.

Hi Aritz,
You helped me out a while back regarding a question about obtaining residency by being married to a Spanish citizen. Now ihave another question.
I was wondering if it is also possible to have a work permit while in Spain, and at the same time have an application pending to obtain residency through my wife. (weird question, i know- but i had to ask).

yes, it is possible.
hypothetically, if someone has a general regime residence and work permit,
there is no point in exchanging it for a european citizen family residence permit.

Yes but im thinking in the long run that its better off to have a family visa because if my residency depends on anything, i’d prefer it to not be attached to a particular job but rather to my wife. Because, what if in the event i quit or get fired, i lose my work permit right? That is why i think to have a family visa is more secure. Please correct me if i am wrong.
Oh and btw,whats a regime permit?

i think in the usa there is a work permit and there is also a resident permit.
but in spain there is a resident permit , an eu citizen dependent resident permit, and there is also a regular resident/work permit.
if somebody loses his/her job, the resident/work permit can be renewed as long as he/she is registered as a jobseeker.
in any case if you are married to an eu citizen, your residency renewal depends on your link to that eu citizen, renewable every 5 years.
if you are married to a spanish citizen, you can apply for citizenship after you accumulate one year residence.
